Terms of Service

By using TourVaultGolf, you agree to these terms. Please read them — they’re written in plain English.

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the TourVaultGolf website, marketplace, and related services (collectively, the “Service”) operated by TourVaultGolf (“we,” “us,” or “our”).

By accessing or using the Service — whether as a buyer, seller, or visitor — you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 18 years of age to create an account or participate in marketplace transactions.

2. The Marketplace

TourVaultGolf is a curated marketplace for the sale and purchase of authenticated tour-issue golf equipment, including but not limited to Scotty Cameron putters, tour-issue wood heads, irons, shafts, wedges, headcovers, and collectibles.

TourVaultGolf acts as a marketplace facilitator. We source, authenticate, and list items on behalf of sellers, and we handle fulfillment and shipping to buyers. We are not a consignment retailer or auction house — we purchase items outright from sellers and resell them to buyers.

We reserve the right to refuse, remove, or limit any listing at our sole discretion, including items we cannot authenticate or that do not meet our quality standards.

3. Accounts

To access certain features — including placing orders, managing a watchlist, or accessing membership benefits — you must create an account. You may register with an email and password, or via Google Sign-In.

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate, current, and complete information when registering and keep it updated.
  • You may not share, transfer, or sell your account to another person.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for an extended period.

4. Buying

All sales are final. Due to the rare and authenticated nature of our inventory, we do not accept returns for change of mind. Exceptions apply only in the case of items that are materially not as described, authentication disputes, or carrier damage — as outlined in our Shipping Policy.

  • Pricing: All prices are listed in US dollars. Prices are set by TourVaultGolf and are firm at the time of checkout.
  • Payment: Payment is due in full at checkout. We accept major credit cards and payment methods supported by our payment processor (Stripe). Orders are not confirmed until payment is successfully processed.
  • Title transfer: Title to purchased items passes to the buyer upon successful delivery and acceptance. Risk of loss passes to the buyer upon carrier pickup if the buyer arranged their own shipping, or upon delivery if we arranged shipping on the buyer’s behalf.
  • Order cancellations: Orders may be cancelled within 1 hour of placement if the item has not yet been packed for shipment. Contact us immediately at info@tourvaultgolf.com.

5. Selling

If you wish to sell equipment to TourVaultGolf, you must submit an inquiry via our contact form or the “Get a Cash Offer” feature. By submitting equipment for sale, you represent and warrant that:

  • You are the lawful owner of the item, or have authority to sell it, and it is free from liens, encumbrances, or third-party claims.
  • The item is genuine and not a counterfeit, replica, or fraudulently modified version of the described equipment.
  • All information you provide about the item (model, condition, provenance) is accurate and complete to the best of your knowledge.
  • The item was acquired through legitimate means and is not stolen or otherwise wrongfully obtained property.

We reserve the right to decline any item for any reason, adjust our offer based on physical inspection, or return items that cannot be authenticated. Items shipped without a confirmed offer may be refused and returned at your expense.

Submitting a counterfeit item is a serious matter. We report suspected fraud to the relevant authorities and cooperate fully with law enforcement investigations.

6. Authentication

TourVaultGolf employs a multi-point authentication process for all items listed in our marketplace. Our authentication methodology includes physical inspection, cross-referencing serial numbers and finish codes, and comparison against documented tour-issued examples.

While we take significant care to authenticate all inventory, TourVaultGolf makes no guarantee of perfect authentication. The collectible golf equipment market involves nuanced provenance questions, and even expert opinion can differ. Our authentication represents our best professional judgment based on available evidence at the time of listing.

In the event of a credible authentication dispute raised by a buyer within 7 days of delivery, we will conduct a secondary review. If authentication cannot be confirmed on re-examination, a full refund will be issued.

7. Payments & Fees

Buyers: You pay the listed price plus applicable shipping charges and any applicable sales taxes. Payment processing is handled by Stripe. We do not store your full payment card information.

Sellers: TourVaultGolf purchases items outright from sellers. Cash offers are made net of our authentication, handling, and resale costs. No additional fees are deducted from the agreed offer. Payment to sellers is issued within 2 business days of offer acceptance via the method agreed upon (ACH bank transfer, Zelle, or check).

Membership fees: Tour Access ($15/month) and Vault Elite ($250/year) membership fees are billed through Stripe according to the billing cycle selected at sign-up. Memberships may be cancelled at any time; cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused membership time.

Sales tax: TourVaultGolf collects and remits sales tax as required by applicable law. The applicable tax amount will be displayed at checkout.

8. Prohibited Conduct

You agree not to use the Service to:

  • Submit, list, or sell counterfeit, stolen, or fraudulently obtained equipment.
  • Misrepresent the identity, condition, provenance, or authenticity of any item.
  • Circumvent, disable, or otherwise interfere with security features of the site, including authentication systems.
  • Scrape, crawl, or otherwise harvest data from the site without prior written permission.
  • Use the site for any unlawful purpose or in violation of any applicable law or regulation.
  • Harass, threaten, or abuse TourVaultGolf staff or other users.
  • Attempt to gain unauthorized access to any account, server, or network connected to the Service.
  • Create multiple accounts to circumvent bans, restrictions, or limits placed on your account.

Violation of these prohibitions may result in immediate account suspension, cancellation of pending transactions, and where appropriate, referral to law enforcement.

9. Intellectual Property

All content on the TourVaultGolf website — including text, photography, design, logos, and code — is the property of TourVaultGolf or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from any content on this site without our express written permission. The “TourVaultGolf” name and logo are trademarks of TourVaultGolf.

By submitting photographs or other content to us in connection with a sale, you grant TourVaultGolf a non-exclusive, royalty-free, worldwide license to use that content for the purpose of listing, marketing, and selling the submitted item.

Brand names and product names referenced on this site (e.g., Scotty Cameron, Titleist, TaylorMade, Callaway) are the property of their respective owners. Their use is solely for the purpose of accurately identifying and describing products and does not imply endorsement or affiliation.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, TOURVAULTGOLF DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any product descriptions, pricing information, or other content on the site.

Market values for collectible golf equipment fluctuate. TourVaultGolf makes no representations about the investment potential or future value of any item sold through the marketplace.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOURVAULTGOLF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU FOR THE TRANSACTION GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

Before initiating any formal dispute, we encourage you to contact us at info@tourvaultgolf.com to resolve the matter informally. We commit to responding within 5 business days and working in good faith toward a resolution.

Any dispute that cannot be resolved informally shall be subject to binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive your right to participate in class action lawsuits or class-wide arbitration.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify registered users via email.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service.
